Terms & Conditions

Your use of the Kamdhenoo Kissan Mart Platform or App and its services and tools are governed by the following terms and conditions ("Terms of Use") as applicable. If You transact on the Platform or App or App, You shall be subject to the policies that are applicable to the Platform or App for such transaction. By mere use of the Platform or App, You shall be contracting with Kamdhenoo Kissan Mart and these terms and conditions including the policies constitute Your binding obligations, with Kamdhenoo Kissan Mart.

For the purpose of these Terms of Use, wherever the context so requires "You" or "User" shall mean any natural or legal person who has agreed to become a buyer/seller on the Platform or App by providing Registration Data while registering on the Platform or App as Registered User using the computer systems. The term "We", "Us", "Our", shall mean Kamdhenoo Kissan Mart.

1. Kamdhenoo Kissan Mart at all times reserves its rights to amend/add/remove/modify (in whole or part), at any time, any or all the Terms & Conditions, or to replace, wholly or in part or not, or to withdraw it altogether, and Kamdhenoo's decision in this regard shall be final.
2. All decisions of Kamdhenoo Kissan Mart regarding running /process/results of the enterprise shall be final and binding on You.  No appeals shall be entertained in this regard.
3. In the event of circumstances arising outside of Kamdhenoo Kissan Mart's control, which in Kamdhenoo Kissan Mart's opinion make it necessary to suspend, substitute, change or cancel the enterprise, Kamdhenoo Kissan Mart reserves the right to suspend, change, substitute or cancel the same at any time.
4. If Kamdhenoo Kissan Mart has suspicion or knowledge, that any entrant/user has been involved in any fraudulent or illegal activity related to the items/services of the enterprise or You have violated the Kamdhenoo Kissan Mart undertaking, policies and processes of Kamdhenoo Kissan Mart, Kamdhenoo Kissan Mart reserves the right to disqualify that entrant/user and any related entrants.  Any entrant/user of Kamdhenoo Kissan Mart Website who, knowingly and with intent to injure, defraud or deceive, files a fraudulent complaint containing false, incomplete, or misleading information may be guilty of a criminal offence and will be prosecuted to the fullest extent of the law.
5. Kamdhenoo Kissan Mart reserves all the rights including but not limited to suspend, block, restrict, cancel the user account, and remove all listings of the errant user and its related user account’s on Kamdhenoo Kissan Mart Platform or App.
6. All commercial/contractual terms are offered by and agreed to between Buyers and Sellers alone. The commercial/contractual terms include without limitation price, ancillary costs, payment methods, payment terms, date, period and mode of delivery, warranties related to items and services and after sales services related to items and services. Kamdhenoo Kissan Mart does not have any control or does not determine or advise or in any way involve itself in the offering or acceptance of such commercial/contractual terms between the Buyers and Sellers.
7. Placement of order by a Buyer with Seller on the Platform or App is an offer to buy the item(s) in the order by the Buyer to the Seller and it shall not be construed as Seller's acceptance of Buyer's offer to buy the item(s) ordered. The Seller retains the right to cancel any such order placed by the Buyer, at its sole discretion and the Buyer shall be intimated of the same by way of an SMS. Any transaction price paid by Buyer in case of such cancellation by Seller, shall be refunded to the Buyer.
8. Kamdhenoo Kissan Mart does not make any representation or Warranty as to specifics (such as quality, value, saleability, etc) of the items or services proposed to be sold or offered to be sold or purchased on the Platform or App. Kamdhenoo Kissan Mart does not implicitly or explicitly support or endorse the sale or purchase of any items or services on the Platform or App. Kamdhenoo Kissan Mart accepts no liability for any errors or omissions, whether on behalf of itself or third parties. Nor is Kamdhenoo Kissan Mart liable for any defect, deficiency, shortcoming, or any risk associated with the quality, commitment, deliver timeline of the items/items/services.
9. Kamdhenoo Kissan Mart is not responsible for any non-performance or breach of any contract entered between Buyers and Sellers. Kamdhenoo Kissan Mart cannot and does not guarantee that the concerned Buyers and/or Sellers will perform any transaction concluded on the Platform or App. Kamdhenoo Kissan Mart shall not and is not required to mediate or resolve any dispute or disagreement between Buyers and Sellers.
10. Kamdhenoo Kissan Mart does not warrant that Kamdhenoo Kissan Mart application will run concurrently and error free. Further, Kamdhenoo Kissan Mart shall not be liable for issues related to technical, human error whatsoever.
11. Kamdhenoo Kissan Mart does not accept, and is not responsible for, any lost or delayed data, communication. Kamdhenoo Kissan Mart reminds You of the nature and limitations of the Internet and is not responsible for any problems, technical malfunctions of any communications network, online system, computer hardware/ software failure, human error, things outside the control of Kamdhenoo Kissan Mart that may affect entry/participation to the enterprise’s business.
12. The items/items/services are listed by third parties who are responsible and liable for complying with commitments, communications, understanding including but not limiting to guarantees, warranties, services (pre, post sales) between them and You, as also complying with applicable law of the land.
13. All communications with You will be, on your mobile number registered with Kamdhenoo Kissan Mart.

The Platform or App is only a Platform or App that can be utilized by Users to reach a larger base to buy and sell items or services. Kamdhenoo Kissan Mart is only providing a Platform or App for communication and it is agreed that the contract for sale of any of the items or services shall be a strictly bipartite contract between the Seller and the Buyer.

Charges

Membership fee or subscription fee to use the Platform or App shall be published at the time app installation. Kamdhenoo Kissan Mart reserves the right to change its Fee Policy from time to time. In particular, Kamdhenoo Kissan Mart may at its sole discretion introduce new services and modify some or all of the existing services offered on the Platform or App. In such an event Kamdhenoo Kissan Mart reserves the right to introduce fees for the new services offered or amend/introduce fees for existing services, as the case may be. Changes to the Fee Policy shall be posted on the Platform or App and such changes shall automatically become effective immediately after they are posted on the Platform or App. Unless otherwise stated, all fees shall be quoted in Indian Rupees. You shall be solely responsible for compliance of all applicable laws including those in India for making payments to Kamdhenoo Kissan Mart Private Limited.

We reserve the right, but has no obligation, to monitor the materials posted on the Platform or App. Kamdhenoo Kissan Mart shall have the right to remove or edit any content that in its sole discretion violates, or is alleged to violate, any applicable law or either the spirit or letter of these Terms of Use. Notwithstanding this right, you remain solely responsible for the content of the materials you post on the Platform or App and in your private messages. Please be advised that such content posted does not necessarily reflect Kamdhenoo Kissan Mart views. In no event shall Kamdhenoo Kissan Mart assume or have any responsibility or liability for any content posted or for any claims, damages or losses resulting from use of content and/or appearance of content on the Platform or App. You hereby represent and warrant that You have all necessary rights in and to all content which You provide and all information it contains and that such content shall not infringe any proprietary or other rights of third parties or contain any defamatory, unauthorised, improper or otherwise unlawful information.

Selling

As a registered seller, you are allowed to list item(s) for sale on the Platform or App in accordance with the Policies which are incorporated by way of reference in this Terms of Use. You must be legally able to sell the item(s) you list for sale on our Platform or App. You must ensure that the listed items do not infringe upon the intellectual property, trade secret or other proprietary rights or rights of publicity or privacy rights of third parties. Listings may only include text descriptions, graphics and pictures that describe your item for sale. All listed items must be listed in an appropriate category on the Platform or App.

The listing description of the item must not be misleading and must describe actual condition of the item. If the item description does not match the actual condition of the item, you agree to refund any amounts that you may have received from the Buyer. You agree not to list a single item in multiple quantities across various categories on the Platform or App. Kamdhenoo Kissan Mart reserves the right to delete such multiple listings of the same item listed by you in various categories.

Payment

While availing any of the payment method/s available on the Platform or App, we will not be responsible or assume any liability, whatsoever in respect of any loss or damage arising directly or indirectly to You due to:

• Lack of authorization for any transaction/s, or
• Exceeding the preset limit mutually agreed by You and between "Bank/s", or
• Any payment issues arising out of the transaction, or
• Decline of transaction for any other reason/s

Item Description

Kamdhenoo Kissan Mart does not warrant that Item description or other content of this Platform or App is accurate, complete, reliable, current, or error-free and assumes no liability in this regard.

Use of Items

Items sold by the Seller are not intended or authorised for illegal consumption/use in any way that may result in violation of the laws governing the state.

If the Buyer uses or sells the Items for use in any such illegal or immoral applications: (1) Buyer acknowledges that such use or sale is at Buyer’s sole risk; (2) Buyer agrees that Kamdhenoo Kissan Mart and the Seller of the Items are not liable, in whole or in part, for any claim or damage arising from such use; and (3) Buyer agrees to indemnify, defend Kamdhenoo Kissan Mart and the Seller of the Items from and against any and all claims, damages, losses, costs, expenses and liabilities arising out of or in connection with such use or sale.

Limitation of Liability

IN NO EVENT SHALL KAMDHENOO KISSAN MART BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT OR CONSEQUENTIAL DAMAGES OF ANY KIND IN CONNECTION WITH THESE TERMS OF USE, EVEN IF USER HAS BEEN INFORMED IN ADVANCE OF THE POSSIBILITY OF SUCH DAMAGES.
